By commissioning me you agree to these terms and conditions. You may ask for more information or message me about any confusion!
General TOS
1. You may not use my art for merchandise, to resell, commercial usage, for NFTs, or AI training. (In general do not redistribute my art for profit gain)

2. You may use my art for personal matters (Edits, printing, etc) as long as you do not resell it.
If you resell your character and its rights away to someone else it is okay to add my commissioned art as a part of its value!

3. You may not edit hateful or Explicit NSFW elements to my commissioned work.

4. You may not commission me if you are a part of my blacklist. Although it is private, if you are blocked you are most likely blacklisted from purchasing from me and you are not allowed to have a middle man purchase for you.

5. ALL payment must be through Goods and Services. Mark as a digital purchase and remove your address! As much as I appreciate the thought, I don't want to accidentally get my account locked or banned over a few cents! Please respect this!!
Commission TOS
When commissioning me I will first ask for a reference image! This will determine if I am able to draw your character or not! Please send a reference in the first message if you can, it helps me out a lot :)
Edits
(This varies on commission type!)
You will get 3 edits per WIP progress (Final sketch, Lineart, Color) and I will do corrections if I have made any mistakes with character for free regardless. However, clothing/patterns/ect must be present on the ref or told to me ahead of time otherwise it counts towards an edit! This varies if my commission info says otherwise.If you wish for more edits, it may result in a fee if complex. I cannot do complex edits to the lineart/pose once past the payment stage.--
Payment
Once sketch is approved I will have you send full payment through Paypal (Digital goods and services) in USD. I cannot make any major edits to the pose or character once payment is sent so please let me know if you want any changes before then! Let me know upfront if you would like shading added to your total! I prefer to keep all payments in one single transaction, so you may be declined if you choose to do multiple.--
Refunds
I will allow partial refunds lineart has not been started yet (30% if Lineart is partially complete, 80% if sketch is complete, 100% if sketch is not complete)Once lineart is complete I cannot refund you.--
References
I will no longer be allowing clients to give me written descriptions of their sonas/characters as that would count as a custom design! Please have a fully colored reference with accurate patterns and colors. Depending on what part of the character I'm drawing (etc. a headshot) this may vary! If your references is heavily shaded/rendered I will require you to provide a color palette in your own time.Its okay if you want a certain pattern removed or if something in your ref is outdated, but you must have a somewhat accurate reference to what your characters patterns or colors look like or I will decline your commission.If you need a quick reference to your character I can recommend some F2U bases for you to quickly color and fill before commissioning me! I do not care about the quality of the ref just as long as it is accurate to you.--
NSFW
I will require proof that you are an adult before purchasing anything NSFW (art with sexually explicit themes or acts including 'sfw' fetish work) or anything with genitalia outside of TH. I do not consider breasts as nsfw as long as it isn't bordering on fetish material. You must be 18 years old or older to purchase nsfw from me. I will not do bathroom/gore/violent fetish work.You cannot upload or post these images with my sfw username unless uploaded to TH.--
Pings
If you feel I am not messaging you for updates please ping me! I may have lost your message if you found me through discord! You are always welcome to ask me for an update so long as it has been at least 10 hours since the last one.Please do not rush me or expect me to finish within the same day! I do finish rather quickly, sometimes within the same day, but emergencies and family life can also slow down my workflow. Expecting me to solely focus on your commission will also slow your wait time as I tend to make more mistakes and must pace myself if I am under constant supervision!
Adoptable/Custom TOS
This applies to characters I design or redesign! Not included in refs unless it is a custom character
SaleAll sales are final, please consider wisely before committing to payment as I will not give you a refund. Please purchase with your health in mind!--
Resale
You are allowed to resell any adopts/customs you have gotten for me. Although I cannot stop you, price gouging will result in a light blacklist + small note on the art/design notes I made with the actual price you purchased the character for. This will be public but not in any of your comment sections.Any art you add can add value to its worth as long as the other party/artist agrees to this.__
Edits or Redesigns
You may edit or redesign as you wish but you can not take me out of the main designer tab if you bought the character directly from me. You may add me as a designer on other tabs if I have redesigned or altered anything, however!You can also add yourself as a designer if you have made significant changes to the design!You can also recreate the design for your species MYO without asking me but you cannot turn the design or anatomy itself into a species without my permission! 8/10 times I will allow it, but please ask first__
Selling to blacklisted individuals
If you resell to someone in my blacklist that has been stalking me or my partner you will be blacklisted for association. If you legitimately do not know them you can appeal if you want, but for my safety I will be enforcing this more often.If it is some random person who got blacklisted for smaller things I do not mind, after all since my list is private I don't expect you to know this information!__
Your own TOS
Your own TOS becomes void when reselling my designs unless its around how offers should be handled!EX. "If you trade with me you cant resell the traded character for money!" Would be null, my TOS will void that. You cannot change or alter how characters with my design label are resold or handled when given to another person. However if its like "You need to pay me within 24 hours" that would be okay! My TOS wouldn't void that!TLDR: Basically, once you trade it away, you aren't allowed to impose rules on the person buying from you.Tradebacks are iffy, but allowed as long as you both agree. Again, this is different if I'm redesigning someone's design, their TOS applies too.__
Non owners
Please don't copy my designs someone else bought, and please don't ask me if you can copy or highly reference it! Chances are I won't see it and as long as it isn't an exact copy with just a few patterns moved around, I personally won't mind. I don't think you can steal colors so go crazy.__
Co-owns
I don't care if you co-own but I will only allow one account to own the character profile itself if uploaded to Toyhouse. I will not be solving any disputes about ownership, please keep that to yourselves.__
Deletion
Character deletion is against my TOS and will result in a blacklist. You may auth only, I don't care, but if you delete a character I have made it will confuse me and I may resell if I think I haven't already sold it yet!
